Surrogacy legislations in Ukraine – Legal Requirements

Ukraine is one of the few countries in Europe where surrogacy is legal for married couples but not for singles or same-sex couples under the Clause 123-Family Code of Ukraine and Order 24 – Health Ministry of Ukraine (Reg. 04.02.97). Under the surrogacy laws, the surrogate mother or the donor do not have any rights of the child born with prospective parents having all the legal rights on the child born through surrogacy in a fertility or surrogacy center in Ukraine.


According to Clause 3 of article 123 of the Family Code of Ukraine, laws allow the intended parents to register their names on the Birth Certificate even if the parents do not have any biological relations with the child born through surrogacy.
